DUTCH PETE'S RANCH POLICIES

RATES
Rates/policies are subject to change and vary during high impact periods and special requests. Payment is collected before the time of reservation.

CHECK-IN/ CHECK-OUT
CHECK-IN: 3:00PM-6:00PM, before nightfall, for a Self-Check-In. We ask that you text your Host (760/937-6581) with a specific Estimated Time of Arrival (ETA) before/within the 3:00-6:00 PM window, when you are an hour away from the property with adequate cellular service. Later arrivals need to be confirmed by the Host. We realize that unforeseen circumstances can happen, which could delay arrival. That said, communication with the Host, one hour before arrival, while with cellular service is of the utmost concern. All efforts have been made to clean and prepare the house for your arrival by 3:00 PM, however, it is possible that there may be unforeseen circumstances that could delay preparedness.

CHECK-OUT: 11:00 AM. Check-out time must be met to allow sufficient time to clean to prepare for the next guests. Guests that occupy the property beyond 11:00AM without prior approval will be charged a late check-out fee equivalent to $50 an hour for each hour beyond the check-out time.

PAYMENT
Payment may be made by credit card.

CANCELLATION
Dutch Pete’s Ranch is an exclusive property where every guest reservation is both important and special to us. If your travel plans change and you must cancel your reservation, please call us at least 30 days prior to your arrival date to cancel your reservation. Cancellations prior to 30 days of the arrival will entitle you to a refund of the total amount charged less a $25 processing fee. Failure to cancel prior to 30 days will necessitate a charge for the full booking. If we are able to re-book your cancelled time slot, we will refund your money less a $25 processing fee. A cancelled reservation fee may be applied as credit, minus $25 processing fee, for a future stay at Dutch Pete’s Ranch; that credit must be used within one year.

FORCE MAJEURE AND PERSONAL MISFORTUNE
We accept no responsibility or liability for any loss or alteration to the terms of your reservation caused by events beyond our control, including, but not limited to, war, terrorist activity, civil commotion, flight delays or cancellations, airport closures, adverse weather conditions, fire, flood, or industrial dispute. We do not accept liability for death, personal injury, sickness, or accident, delay, damage or loss of luggage or personal effects, or any loss or misadventure that may affect the guest(s) reservations.

FAILURES OF UTILITIES, EQUIPMENT, SERVICES & FAILURES BEYOND OUR CONTROL
As a routine practice, we check the house and property to be sure everything is in good working order. We do not accept any liability for consequences due to failure of supplies such as water, electricity or gas, or failure of equipment, either outdoors (e.g. internet, generator, solar panels) or indoors (e.g., faucets, refrigerator, television, water heater, washing machine), or consequences due to unknown defects in the house (e.g.leaky roof). This does not affect your statutory rights as a consumer. Should a failure occur that affects your stay, we will promptly seek a remedy. We do not accept any liability for the consequences of actions or omissions of persons who may control or supply services, or any actions taken in the vicinity of the property, by any authority over which there is no control.

DAMAGE OR LOSS
The Principal Guest is directly responsible for damage or loss to DUTCH PETE’S RANCH as a consequence of the action, or lack of action, of any of the guests or their visitors, including failure to secure doors and windows while they are absent or upon their departure. The amount due will be determined by the replacement cost for a new item, and if applicable, cost of labor and materials. Irreplaceable items will be assessed at their closest like-kind-quality current retail replacement value. (E.g. intrusion of rodents, torn linens, stained wood floors or furniture can be considered damage/loss.)

INTERNET WIFI SERVICE
The privilege of offering a Wifi service is for basic communication, eg: internet phone calls, and email. Because of the remoteness of property and limited data available through the Wifi, downloading of gaming, streaming, and movies is discouraged and can lead to a severely slow internet speed. Please bring your downloaded films with you on your personal devices. Thank you.

CLEANING
The Principal Guest is responsible for excessive cleaning costs (e.g., washing dishes, dirty pans, or an excessively dirty oven), and services not included in the rental fees (e.g., disposing of boxes or large amounts of trash). Should we find personal property after guests’ departure, we are willing to return it at the guests’ expense.

FEES RELATED TO DAMAGE, LOSS, EXCESSIVE CLEANING OR DATA USE
Costs related to property damage, loss, excessive cleaning or data use, will be charged to the guest, with an explanation provided by the Host or management. The Principal Guest will be responsible for all legal fees if legal action is required by the owner of DUTCH PETE’S RANCH to recover costs related to damage and loss, provided that those costs are determined by a court or an arbitrator to be the guests’ responsibility.

OTHER SAFETY RULES and GUIDELINES ON THE PREMISES
Children and minors under the age of 18, must be in the care of an adult (25 years & older) on the property at all time.

Dutch Pete’s Ranch has a firm no smoking/no open flames/no vaping inside-the-house policy. Smoking in the pasture and sagebrush on property is not permitted.

Open flame and fires are not allowed on the property.

One dog pet is allowed for an additional fee (see Reservation form). The Pet is not allowed to stay home alone. The Pet must be in the company of owners at all times. The Pet is not allowed to free-range, for the safety of grazing cattle and other wildlife. Pet owners should be aware that we have an active coyote population, a potential predator for your pet.

Guests are not allow to use firearms or other lethal weapons on the property for recreational use or hunting.

ATVs and mountain bikes are not permitted on the property, other than on main driveway to and from house.

The 500+ acre property to the north, Black Lake Preserve, is owned by the Eastern Sierra Land Trust. Guests may walk on that property; please respect the signs. We do not recommend boating or walking along shore or in lake areas, because of the thick, bottomless dangerous mud.

Use of any part of the property by non-registered visitors is not allowed without prior consent of the owner. Violations of any of these policies are subject to early termination of rental period with no refund.

The management reserves the right of entry to any part of the property, at any time and for any reason.

RELEASE OF LIABILITY, CONSENT FOR EXPOSURE TO DANGEROUS AND HAZARDOUS CONDITIONS, AND ASSUMPTION OF THE RISK

Parties: The “Host” is DUTCH PETE’S RANCH, its owners, paid representatives, and lessee(s). The “Guest” is the person or persons, whose name or names appears below, and any minors or dependents accompanying that person or persons.

RANCH (also referred to as the "Premises"): The land and the improvements situated on Dutch Pete’s Ranch in Mono County, California.

I (we) acknowledge and understand the Host makes no warranties, either express or implied, as to the condition and/or safety of the Premises and the improvements located thereon.

Warning of the Dangerous Conditions on Premises
The dangerous conditions listed below serve to warn me (us) and make me (us) aware, appreciate and understand that dangerous conditions, risks and hazards exist, both obvious and latent, both natural and man-made, that can cause serious bodily injury or death and damage or destruction of my (our) personal property. My (our) presence and activities on the premises expose both me (us) and my (our) personal property to these dangerous conditions, risks and hazards, both obvious and latent and both natural and man-made, including, but not limited to poisonous and non-poisonous snakes, insects and spiders; ditches, eroded areas, holes, springs, mud, uncovered historic stuff, steep inclines, sharp and jagged rocks located both on and off roadways, trails and in brush that create rough, hazardous and dangerous driving, and walking conditions; thorny and prickly plants; animals both wild and domestic that may be diseased and/or possessed with propensities to injure or kill; rushing and still water with perils lurking above and beneath the surface; persons with firearms and other lethal weapons both on or off the premises; the presence of barbed wire to restrain livestock; historic glass, ceramic, obsidian shards; and the use of vehicles, horses, ATVs both on and off trails, roadways, ponds and lakes.

AGREEMENT AND WARNING: I UNDERSTAND AND ACKNOWLEDGE THAT AN AGRITOURISM ENTITY IS NOT LIABLE FOR ANY INJURY TO OR DEATH OF AN AGRITOURISM PARTICIPANT RESULTING FROM AGRITOURISM ACTIVITIES. I UNDERSTAND THAT I HAVE ACCEPTED ALL RISK OF INJURY, DEATH, PROPERTY DAMAGE, AND OTHER LOSS THAT MAY RESULT FROM AGRITOURISM ACTIVITIES.

Waiver and Release of Claims
In consideration for the right to enter the Premises, I (we) hereby waive and release all claims and agree to indemnify, defend and hold harmless the Host named above, his or her (or the) respective owners, heirs, agents, representatives, assigns, or lessees from and against any and all claims, demands, causes of action and damages, including, but not limited to, court costs, judgments and attorneys’ fees resulting from any accident, incident or occurrence arising out of, incidental to or in any way resulting from the use of or my (our) exposure to the conditions of the premises or the Host’s active or passive negligent conduct thereon. These include, among other things, injury or death to the undersigned and damage or destruction of the undersigned’s personal property. Also, I (we) hereby further covenant and agree that I (we), my (our) heirs, agents, representatives, successors or lessees by reason of the Host’s active or passive negligent conduct or by reason of the condition(s) of the Premises, whether natural or man-made and whether the condition is caused by the Host’s active or passive negligence.

Assumption of the Risk
Furthermore, I (we) hereby agree and declare that the “Warning of Dangerous Conditions on Premises” stated earlier serves to warn me (us) of any actual and/or potentially dangerous natural or man-made condition(s) that I (we) may reasonably expect to encounter on the Premises that may cause serious bodily harm or death or cause damage to our destruction of my (our) personal property. I (we) hereby state that I am (we are) aware of the dangerous conditions, risks and hazards mentioned earlier and that I (we):

1.) Understand and appreciate the nature and extent of the risks and dangers of being exposed to those and other associated dangerous conditions and
2.) Voluntarily, expressly and knowingly consent to exposing myself (ourselves) and my (our) personal property to those and other associated dangerous conditions

By affixing my (our) signature (s) below, I (we) knowingly and expressly ASSUME THE RISK of my (our) exposure to the dangerous conditions, risks and hazards expressed above. This assumption of the risk may be used by the Host as a defense in a court of law. , against any allegations either for negligence or gross negligence for failing to warn me (us) of any dangerous natural or man-made conditions that I am (we are) apt to encounter expectedly or unexpectedly on the premises. This assumption of the risk does not extend to Host’s reckless or intentional conduct.

The Severability Clause
If any term, provision, covenant, release, assumption or condition of this agreement is held by a court of competent jurisdiction to be invalid, void or unenforceable, the remainder of the provisions shall remain in full force and effect and shall in no way be affected, impaired or invalidated.

Length of Agreement
This Release and Assumption of the Risk Form applies during the time that I am (we are) permitted on the premises, now and in the future, and until this agreement is revoked in writing.

Parental, Guardian and Supervisory Responsibility for Minors and Indemnification for Injuries or Deaths.
In consideration for allowing minor(s) to accompany me (us) on the Premises, I (we) agree to keep close supervision of the minor(s) in my (our) watch and care at all times. I (we) further agree to defend and indemnify the Host for all claims stemming from the injury and/or death of a minor or minors in my (our) watch and care caused by my (our) lack of or negligent supervision.
